Who is Liable in a Rideshare Accident?

Uber and Lyft operate in a unique manner. Unlike taxis, which are owned by a company and driven by an employee, rideshare drivers are independent contractors. This means that they are not employees of Uber or Lyft, but instead work for themselves. However, this does not mean that rideshare companies are never liable for a crash.

In a rideshare accident, liability will depend on the driver’s status at the time of the crash:

  • If the driver is not logged into the app and is not accepting fares, then he or she is considered “off the clock.” In this situation, the driver’s personal auto insurance policy will be responsible for covering the crash.
  • If the driver is logged into the app but has not yet accepted a ride request, then the driver is considered “on the clock” but not actively working. In this situation, the driver’s personal auto insurance policy will still be responsible for covering the crash. However, Uber and Lyft also provide “contingent coverage” in case the driver’s insurance does not fully cover the crash. These policies have different coverage limits depending on the driver’s insurance status at the time of the crash.
  • If the driver is “on the clock” and actively working (i.e. has accepted a ride request and is on the way to pick up the passenger or is driving the passenger to his or her destination), then the rideshare company’s insurance policy will be responsible for covering the crash. These policies have much higher coverage limits than the contingent coverage policies.

In some cases, the rideshare company may be liable for a crash even if the driver is not “on the clock.” For example, if a driver has a history of traffic violations or a DUI conviction, the company may be liable for negligent hiring or negligent retention. Additionally, if a rideshare driver is “on the clock” and causes a crash, the company may be liable for the driver’s negligence.
